How will you make an impact in this role?
Reporting to the Vice President, Chief Compliance Officer, this role’s mandate covers the Bank’s Anti-Money Laundering and Terrorist Financing as well as the Privacy programs. It also covers compliance strategy for the Bank. The role will have three strategic components: 1- Management of the Bank’s AML Program and team; 2- Management of the Bank’s Privacy Office and team; 3- Management of the Bank’s future-looking strategy which covers matters related to open banking, fintech/regtech, AI/ML, as well as elements of ethics, conduct, and financial literacy.
Deputy AML Officer:
As DAMLO, the incumbent has responsibility for providing strategic direction, thought leadership and counsel on regulatory requirements for the Anti-Money Laundering & Anti-Terrorist Financing (AML/ATF), Sanctions and the Anti-Corruption (AC) Compliance Programs (collectively ‘Programs’) for Amex Bank of Canada (Bank), in accordance with legal and regulatory requirements and internal American Express policies. The DAMLO will lead in the development, implementation, and enhancement of AML/ATF Programs.
Responsibilities include:
- Proactively identify, communicate, and report on strategic insights, emerging risks, industry trends, changes in regulatory requirements and current events to key stakeholders in the Bank. Advise on and implement solutions for eliminating related risks.
- Provide strategic direction and partner with stakeholders locally and globally on the Programs activities and define road maps for implementation of enhancements, programs and activities related to AML/ATF, Sanctions and AC. Partnering with global stakeholders is particularly a key skill that would be required for the incumbent to be successful in their role.
- Responsible for the leadership, ongoing execution and improvement of the Bank’s Programs including policies, procedures, reporting, risk assessments and compliance training program.
- Ensure quality and consistency of AML/ATF, Sanctions and AC standards and performance across the Bank. Provide recommendations to correct any deficiencies or improve upon business practices and for adhering to legal and regulatory requirements and internal American Express policies.
- Work with multiple internal, external, and global stakeholders to help build an appropriate risk culture with respect to AML/ATF, Sanctions and AC. This includes periodic meetings with key Executives for information sharing and pro-active discussion of key compliance matters.
- Develop and present reports at multiple levels within the organization including to Senior Management in respect of the AML/ATF, Sanctions and AC Programs, its adequacy, any detected issues, or deficiencies.
- Support business partners with their activities, projects, and initiatives.
- Build a high-performance environment and implement a people strategy that attracts, retains, develops, and motivates their team by fostering an inclusive work environment; communicating vison/values/business strategy and manage succession and development planning for the team.
Deputy Privacy Officer:
As DPO, the incumbent has responsibility for the management of the Bank’s Privacy Office. The DPO will also provide significant input into the strategic direction, improvement, and timely implementation of the Bank’s Privacy Program to ensure appropriate governance and protocols for compliance with applicable laws, regulations, and industry best practices and standards.
Responsibilities include:
- Responsible for the execution, adequacy, accuracy and timeliness of the Bank’s Privacy Program including Policies and Procedures, Privacy Risk Assessments, Privacy Access Requests, Privacy Complaints, Privacy Breaches, Training, and conduct on-going reporting of Program results.
- Communicate new regulations and legislation, emerging risks, regulatory trends, and best practices and develop and provide specialized training as needed.
- Work on building a collaborative relationship with regulators, ensuring submissions are reviewed and submitted on time, devising a process to track timely submissions (OPC as well as provincial regulators, and some global regulators as needed).
- Support and promote compliance with internal policies and processes related to data protection & records and information retention & disposition.
- Help building compliance programs in partnership with the business to continuously identify opportunities for improvement required in business processes, product design, capabilities or technologies, colleague training and or procedures to address common themes a required on special projects assigned to the incumbent.
- Creation and implementation of KRIs / smart monitoring and establishing reporting and monitoring programs (i.e., Business Self Testing) to cover the Bank’s Privacy Program.
Head of Compliance Strategy:
As Head of Compliance Strategy, the incumbent has responsibility for contributing to the development and maintenance of a strong Compliance regime and culture that provides effective management of compliance programs in accordance with the local market legal and regulatory requirements and internal American Express policies.
Responsibilities include:
- Establishing strong partnerships with operations, business, and leadership teams as well as oversight functions to provide oversight on effectively regulatory risk management.
- Maintaining a clear understanding of the regulatory requirements, internal expectations, and processes across all lines of business in order to successfully control and mitigate any risk.
- Lead special compliance projects which entail providing significant input into the strategic direction and improvement of the Compliance program in the Canada market and globally, devising and implementing policies and procedures to achieve compliance, identifying applicable legal compliance requirements and regulations, ensuring appropriate compliance-related training programs are conducted, and providing guidance to the business on compliance issues and support regulatory relationships, as required.
- Lead the development and monitor the implementation of compliance strategy goals, conduct on-going reporting of strategy results, and consult on business activities needed to close identified compliance gaps in a timely and effective manner.
- Talent development and people leadership. Lead, recruit, manage, develop, mentor, empower and review performance and talent assessment of compliance colleagues.
- The role will have a specific focus on matters related to open banking, fintech/regtech, AI/ML, as well as elements of ethics, conduct, and financial literacy. The role will also cover other compliance strategy / initiatives as operationally needed or directed by the CCO.
Qualifications:
- At least 15 years of experience in Compliance, Legal, Risk, Audit or other related area acquired in government or a highly regulated industry (Financial Institution experience preferred).
- At least 5 years of experience in AML and Privacy.
- University degree in related field or equivalent combination of education and business experience. JD / LLM / MBA or other postgraduate degrees or professional designations would be considered an asset.
- Professional certifications are highly desirable.
- Experience dealing with Federal and Provincial regulators would be considered an asset.
- Proven managerial experience with a track record of driving sustainable change, leading, and motivating a team preferably with experience with identifying critical resources and building a team from the ground up.
- Data driven leader that understands and identifies automation opportunities to drive efficiencies and change.
- Strong relationship-building skills and the ability to collaborate and work effectively with internal colleagues across the Enterprise.
- Experience collaborating with multiple business units while leading enterprise programs that require understanding of technology implementation would be an asset.
- Strong program and project management skills with a proven track record of managing multiple projects in a high-pressure environment.
- Proven strategic thinker with the ability to prioritize and implement sustainable solutions to address gaps and improve efficiencies.
- Ability to effectively work with and influence stakeholders at different levels locally and globally.
- Strong business acumen, ability to multi-task, work independently and prioritize effectively.
- Comfort with taking the lead, defining strategies, recommending solutions, and informing stakeholders.
- Demonstrated ability to make decisions independently, work well under pressure, meet deadlines, and adapt easily to frequent change.
- Proven business transformation and leadership skills including process improvement, project management, system capabilities and analytical skills.
