The General Counsel’s Organization (GCO) at American Express is seeking a Director & Counsel to support the Amex Offers marketing and sales teams. The Amex Offers program is Amex’s card-linked offers platform, delivering exciting offers to Amex Card Members and advertising opportunities to Amex accepting merchants. This role will require drafting and negotiating agreements with merchants, content suppliers, platform providers and other promotional partners, as well as contributing to oversight of the program and review of sales practices and related materials.
This role sits on the Global Merchant and Network Services (GMNS) GCO team. The GMNS business is a core business of American Express and fundamental to the operation of the American Express global payments network. GMNS builds and maintains relationships with merchants that choose to accept the American Express Card and financial services companies who enable merchants to accept the Card, simultaneously delivering differentiated products and services and driving revenue growth for both merchants and American Express.

Here’s just some of what you’ll do in this role:
· Provide legal support, oversight and advisory support to the team that engages in sales and promotion of Amex Offers and related merchant-facing advertising initiatives
· Draft, negotiate and advise on merchant-facing program terms, advertising and promotional contracts including sponsorship agreements, content licensing agreements and other co-marketing initiatives
· Support implementation and ongoing relationship needs of offers-related content sourcing and advertising platform deals globally; coordinate with local counsel and other stakeholders
· Advise the business team on data- and privacy-related issues in support of various merchant value-add initiatives
· Manage and uplift various marketing agreements and templates
· Review and advise on training and sales materials for B2B advertising programs, including Amex Offers
· Serve as a subject matter expert on merchant-facing aspects of Amex’s B2B marketing and advertising programs
· Participate in a small team of seasoned attorneys, offering thought leadership for cross-subject matter issues and projects
Minimum qualifications:
· Bachelor’s degree & J.D.
· Experience in advertising/marketing law, with knowledge of best practices in advertising/marketing/media buys
· Interest in and passion to learn about the payments industry
· Admitted to New York Bar or eligibility to do so
· 6+ years of relevant legal experience
Preferred qualifications:
· Strong analytical and problem-solving skills
· Knowledge of advertising laws, including FTC guidelines and UDAAP/UDAP principles
· Demonstrated experience in gaining credibility, managing expectations, and developing strong working relationships with legal colleagues and clients
· Ability to communicate complex issues clearly and persuasively, in both written and oral format
· Experience with the payments or e-commerce industry or merchant acquiring
· Strong leadership skills, growth mindset and strong customer focus
Salary Range: $170,000.00 to $255,000.00 annually + bonus + equity (if applicable) + benefits
